O-1 Extraordinary ChefsThe O-1 category is ideal for highly talented or acclaimed foreign chefs who may not qualify in other work-related nonimmigrant categories such as H, L, or J, or for those who wish to avoid those classifications for various reasons. It is especially useful to high-end chefs lacking professional degrees. As an alternative to some other categories, it is a particularly useful and flexible classification because O status does not have a wage maintenance feature nor a cap.
O-1 status is granted to the petitioned chef who is of extraordinary ability or achievement. Such extraordinary culinary ability may be evidenced by accomplishments such as the receipt of a nationally or internationally recognized prizes/awards for excellence in the culinary field (e.g., James Beard Foundation Award) or membership in associations in the field that require outstanding achievement of their members, as judged by recognized national experts (e.g.) Master Chefs of France.
The period of authorized stay for the O category chef is for such time that is necessary to provide for the completion of his/her culinary duties, but no more than three (3) years. Extensions to continue/complete the SAME activities may be obtained for one (1) year at a time. |
